What to Expect Following a Traumatic Brain Injury

 

This case involves Brooklyn medical malpractice that caused the wrongful death of a 17 year old girl as a result of a brain injury that occurred at the defendant Brooklyn hospital. The decedent fell and hit her head, and as a result of her idiopathic thrombocytioenia (ITP) and injury caused by the defendants' negligence and improper medical care, her health worsened and she passed away just days after. The young girl had a past history of blood clots in her cheek, which were attributed to cheek biting by her private medical doctor. On April 14th, she developed bleeding in her gums and went to a dentist, where she was immediately referred to the defendant Brooklyn hospital emergency room. A diagnosis of suspected idiopathic thrombocytopenia was made, which is a disorder that prevents blood from clotting. Upon admission to the hospital, she seemed to be doing quite well, except for the ITP. The hospital chart contains a nurse’s note on April 16th at 7 a.m., which indicates that the patient required side rails up at all times for safety and that the patient had been instructed to call for assistance whenever she got out of bed. The note also reports that the patient was found lying down in the bathroom, lethargic.

 

The patient had a CAT scan and was diagnosed with an intracranial hemorrhage. The hospital staff related the hemorrhage to her fall in the bathroom. Prior to the nurse’s notes regarding the side rails, there were no doctor’s orders indicating any such restriction. Her ITP continued to progress and on April 18th at 1:00 p.m., there was a hematology consult for possible plasmapheresis, which is a blood purification procedure.

 

An order should have been written that confined her to her bed because of her low hematocrit and hemoglobin and her complaints of dizziness, and, in light of the fact that if she fell she was at increased risk of bleeding to death.

 

After the fall, the patient was transferred to the pediatric unit where her condition deteriorated even further. On April 18th, she was diagnosed as being brain dead. The physicians were considering plasmapheresis to avoid the brain bleed from spreading, however it did spread. She died on May 1st as a result of the medical malpractice of the defendants. The cause of death on the Death Certificate is blunt impact injury of head due to idiopathic thrombocytopenia (“ITP”).
