Birth Injuries
“I recognize that my birth injury lawyers Brooklyn have done a substantial amount of work in preparing this case for trial, being ready for trial, and obtaining, retaining, and meeting with expert witnesses. I recognize the extraordinary efforts of the staff of SILBERSTEIN, AWAD, & MIKLOS, P.C., in persistently and diligently pursuing and prosecuting this matter throughout the years.” — M.V.
Silberstein, Awad & Miklos, P.C. was successful in obtaining the largest settlement without the need for a trial in history against the Nassau County Medical Center on behalf of a child who experienced cerebral palsy birth injury due to her premature birth at 31 weeks. The negligence involved a procedure performed on the mother, which caused an infection of the amniotic fluid. The doctors then failed to properly rescue the baby by performing a timely caesarean section.
Our birth injury attorneys were also successful in obtaining a $56 million verdict for a baby who was born with a condition called spina bifida as a result of a drug that was improperly prescribed to his mother during her pregnancy. The infant was unfortunately born with paralysis and injury to his brain. The $56 million verdict does not make up for the damage, but it will ensure that the boy will have safety, security and comfort for his entire life.
For over 20 years, our firm has represented children suffering lifetime injuries that could have been prevented if only the child and/or their mother had received proper medical care during birth.
We have successfully handled cases where there was:
- a failure to properly monitor the baby
- a failure to properly interpret the fetal monitor
- a failure to properly treat an infection
- a failure to properly treat umbilical cord compression
- a failure to properly respond to fetal distress
- a failure to timely perform a cesarean section
- a failure to properly use pitocin
- a failure to render proper prenatal care
- a failure to properly calculate the due date
- failure to properly use vacuum extractors and forceps
- a failure to timely treat vaginal bleeding
- a failure to give proper newborn care
- and other failures
Birth injuries that may have been caused by medical malpractice include cerebral palsy and Erb's palsy. Unfortunately, there are times when the birth of a baby and all the joy and promise of a newborn are forever damaged because of medical and hospital malpractice. If this has happened to you or someone you love, our birth injury attorneys Bronx can help.

During pregnancy, labor and birth, a doctor, nurse or hospital employee has a responsibility to the mother and her baby to monitor and manage their medical conditions. When a doctor, nurse or hospital employee fails to provide reasonable care, the infant can suffer a lack of oxygen, infection or trauma, all of which can cause damage to the very delicate brain of a baby and other permanent consequences. Sometimes, grieving parents are simply told that there has been a "complication," which can be nothing more than a concealment of negligence.
Our multi-million dollar recoveries for children who were injured during labor and birth at hospitals in Manhattan, Brooklyn, the Bronx, Queens, Nassau and Suffolk have provided lifelong financial support for medical or custodial care and special needs such as housing, wheelchair access, bathroom and sleeping accommodations. This money provides parents with the assurance that their son or daughter's life will remain safe and secure, even when the parents are no longer around. We have also established special Supplemental Needs Trusts for these children, which allows for money to go into a trust to be spent only on the needs of that child, while also preserving eligibility for federal or state funding such as (SSI) or Medicaid health coverage.
