Construction Site Accidents

"This firm was willing to think outside the box, to pursue relentlessly highly credentialed medical experts and apply aggressive trial technique throughout discovery and trial of the matter. But for their perseverance and dedication, this result would not have been possible." — C.G.

Construction sites can be hazardous places to work. Thousands of construction workers are either injured or killed in construction site accidents each year.

New York Labor Law Section 240 requires that "all contractors and owners, in the erection, demolition, repairing, altering, painting, cleaning or pointing of a building or structure shall furnish or erect scaffolding, hoists, stays, ladders, slings, hangers, blocks, constructed, placed and operated as to give proper protection to a person so employed." Section 241 (6) of the Labor Law requires that "all contractors and owners shall comply with the requirement that all areas in which construction, excavation or demolition work is being performed shall be so constructed, shored, equipped, guarded, arranged, operated and conducted as to provide reasonable and adequate protection and safety to the persons employed therein or lawfully frequenting such places."

Silberstein, Awad & Miklos, P.C. has a long history of applying these safety laws for the benefit of construction workers, obtaining substantial money damages that secure their families' futures and compensate for the injuries incurred. Our firm has recovered millions for carpenters, electricians, iron workers, glazers, masons, teamsters and others hurt at construction sites. We also offer legal representation for workers' compensation, social security and disability benefits.

Our firm has 20 years of experience representing construction workers who have received serious injuries while working at a construction site or on the repair of a building. These injuries are even more devastating when the injured party is a working parent or spouse. We have been successful in obtaining financial security for that person and his or her family, including electricians, carpenters and various other craftsmen and laborers.

Because of the usual severity of a construction site injury, settlements can be for hundreds of thousands or even millions of dollars in compensation.

A premises liability attorneys experienced in representing injured workers is vital to obtaining full and just compensation. The interpretation of the State of New York's Labor Law has been delegated to the Appellate Courts. This is a dynamic area of the law. Because complex interpretations of the law may affect the outcome of your case, you should have the benefit of a lawyer experienced in this field who is knowledgeable about how to properly investigate an accident, as well as one with experience in trying cases to a verdict. In choosing a lawyer, be sure to ask about the firm's experience in Appellate representation in this area.
