New York Labor Law §200 is designed to make certain that all construction sites are so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all construction workers employed or lawfully frequenting such construction sites. The owners of the construction site have a duty to correct any unsafe conditions that they know about through reasonable inspections. When owners fail to perform reasonable inspections and fail to fix unsafe conditions on the site, workers get injured. New York Labor Law §240(1) is commonly referred to as the scaffolding law. This particular statute requires all contractors and owners to make certain any workers involving erection, demolition, repairing, altering, painting, cleaning, or pointing of any building or structure shall be provided with the necessary safety tools such as scaffolding, hoists, stays, ladders, slings, hangers, blocks, pulleys, braces, irons, ropes and other devices. New York Labor Law §241(6) governs all areas in which construction, excavation or demolition work is being performed shall be so constructed, shored, equipped, guarded, arranged, operated and conducted as to provide reasonable and adequate protection and safety to the persons employed therein or lawfully frequenting such places. This statute entails enforcement and applications of various provisions of the industrial code that govern work site safety.
