Defective Roadways
Bronx, Brooklyn, Long Island, Queens, Manhattan, New York City, NY
There are millions of miles of roads and millions of vehicles driving on them every day. Over time, these arteries of commerce and travel degrade and need to be repaired. Defective roadways that are not properly maintained may cause, or make a car accident more severe than it otherwise would be.
In cases where a defective roadway exacerbated or directly influenced an accident resulting in injury or death, those responsible for building or repairing the road should be held accountable. New York accident attorneys, Silberstein, Awad, & Miklos, P.C. are here to help ensure you are properly compensated if you are injured as a result of a defective roadway.
Roadway Design
Except in newer subdivisions, the vast majority of roadways were laid years ago when vehicles were slower and smaller. The roads were basically reinforced pathways leading from one rural area to another with little regard for traffic safety. Many of these narrow winding roads contribute directly to traffic accidents because of their poor design.
Some of the design factors that make roads unsafe include:
- Missing guardrails
- Inadequate warning signs
- Narrow roadbeds
- Missing shoulders
- Sharp curves
- Large dips and steep hills
Most new roads are properly designed with built in safety features, but in too many cases, the contractor, in trying to cut corners or underbid the competition will take shortcuts, which directly affect the quality of the road. This sort of shoddy work needs to be addressed when it results in a vehicle accident.
Roadway Repair
When roads go bad, they deteriorate quickly. That is why they are constantly being repaired and updated. In a tight economy, many of these repairs go undone for too long making the roads dangerous. Some of the factors that contribute to accidents include:
- Large potholes
- Soft shoulders
- Dips in the road
- Uneven road sections
Again, many of these factors are because of contractors rushing through the job in order to meet a deadline, leading to inferior repair jobs.
Roadway Improvements
As roads are repaired, many safety features are added to address the design flaws in older roads. Some of the improvements that make driving safer include:
- Rumble strips
- Widening the road
- Straightening curves
- Flattening hills
- Installing guardrails and reflector
- Adequate road signs
Despite these safety features, there are still far too many motor vehicle accidents caused by defective roadways. If you are involved in an accident in New York, including Brooklyn, Long Island, or the Bronx, please contact the defective roadway attorneys at Silberstein, Awad, & Miklos, P.C. to schedule a free initial consultation.
