“I had the opportunity to observe and be aware of the manner and method in which SILBERSTEIN, AWAD & MIKLOS, P.C., particularly by Joseph Awad, conducted themselves and provided legal representation to KATHRYN during her lifetime On behalf of KATHRYN, myself and my two sons, I request the Court to recognize the very substantial quantity and quality of legal research, medical research, expert consultation and excellent litigation and trial preparation performed by this law firm through the years of their service. ”
— K. Cannon

The medical negligence attorneys at our law firm have represented many women and men who have been harmed because of the delay in diagnosis of their cancer, through no fault of their own.

Cancer Treatment: The earlier the treatment, the better the prognosis for patients with:

  • colon cancer,
  • breast cancer,
  • skin cancer,
  • leukemia, certain lymphoma
  • lung cancer,
  • renal cancer, kidney cancer,
  • testicular cancer,
  • brain cancer,
  • prostate cancer,
  • most other forms of cancer .

Unfortunately, there are times when a patient's cancer goes undiagnosed and untreated, even though the patient is presenting classic complaints and symptoms that should alert a careful physician to the possibility of cancer.

Delay in diagnosing and treating cancer harms a patient because the cancer may grow or spread, the stage of the cancer may increase, and the prognosis worsens. The amount of medical treatment a patient may need is sometimes greatly increased and may necessitate additional surgery, chemotherapy, or radiation therapy.

Our medical malpractice attorneys have successfully prosecuted cases against radiologists, internists, gastroenterologists, gynecologists, dermatologists, family practitioners and recovered hundreds of thousands of dollars in compensation for many clients because of the delay in the diagnosis and treatment of cancers.

For example, we have represented many women who were harmed because their breast cancer grew or spread during a time interval when they could have received medical care and treatment, had the physician acted in a reasonably careful manner. We have represented women who were screened with mammography, and though the mammogram showed suspicious microcalcifications, it was reported as being benign without any suspicious findings. We have prosecuted cases where these calcifications have turned into tumors and, in some instances, have spread and metastasized.

In Queens County, New York City, we recovered $1,000,000.00 for the family of a woman who should have had a biopsy of a breast lump a year earlier. The delay of one year permitted the malignancy to grow and spread into the lymph nodes and distant body organs (liver and brain).

In another case, we sued the Chief of Surgery and Chairman of the Department of Surgery and Dean of Medicine at a major university hospital because that physician misdiagnosed the signs and symptoms that a young woman was presenting indicative of a breast cancer known as inflammatory breast cancer. A delay of four months hurt this woman because her chances for successful treatment were reduced significantly by the failure to start treatment. Because of this case and others, this man was forced to step down and a state investigation of him suspended his license to practice medicine.
