Experimentation and Improper Procedure Medical Malpractice
Medical errors are all too common. Two similar types of medical errors that could be deemed medical malpractice are experimentation and improper procedure.
Experimentation
When you visit a health care professional for treatment, you trust that the treatment they provide, the procedures they perform and the medications they prescribe are approved by reputable medical organizations. If, however, you receive unorthodox treatment not considered standard of care resulting in injury, you may be a victim of medical malpractice. The term “standard of care" implies that any other reasonable medical professional would have provided the same treatment given the same circumstances.
Improper Procedure
Health care providers are trained to follow specific procedures for specific situations. If a medical professional fails to offer the standard procedure, such as timely treatment or obtaining informed consent, you may be a victim of improper procedure medical malpractice.
If your health care professional does not obtain informed consent, and you are injured during the procedure, then you may have grounds for filing a medical malpractice claim. For instance, if your doctor suggests a surgery, but fails to inform you of possible harmful side effects and you experience one of those side effects, it may be surgical medical malpractice.
Although you can take measures to avoid suffering an injury such as researching your physician and his or her credentials, as well as the procedure being recommended, you may still find yourself in need of an experienced medical malpractice attorney.
