Medical Malpractice during Cesarean Section
This is an example of a medical malpractice case that we successfully handled for a Bronx mother and her infant son.
This case involves a failure on the part of the hospital and physician to timely perform a cesarean section in the face of serious complications. The baby is born at a local Bronx hospital on May 25, 2003 via a normal spontaneous vaginal delivery. Induction by pitocin was required due to a lack of amniotic fluid called oligohydraminos. During the process of delivery the baby fails to proceed normally down the birth canal due to a shoulder dystocia. The baby's shoulder had become wedged behind the mothers pelvic bone.
Instead of performing a timely cesarean section the mother was allowed to labor until she ultimately delivered her infant son vaginally. The baby was born almost dead. There was no heart rate, no respirations and the baby was limp. Estimations of the baby's overall condition were made using an Apgar score. A perfect score is usually 10 and is measured at intervals of 1,5,10 and 15 minutes. This baby's Apgar scores were 0,0,0 and 4. The child required resuscitation and assistance with his breathing. An endotracheal tube was placed to allow the child to breathe. He was ultimately placed on a ventilator which assisted in breathing.
During the baby's stay in the neonatal intensive care unit he experienced seizures, decreased kidney function, inability to urinate and an intraventricular hemorrhage or bleeding in the brain. He required tube feedings and had erbs palsy. The erbs palsy resulted in limited ability to move his arm.
As he progressed and grew, it was diagnosed with cerebral palsy and global developmental delay. He had difficulty with language, motion and speech. His intelligence was below normal and he was classified as mentally retarded with global developmental delays. He has a lifetime of therapies and custodial care to look forward to.
As a result of the medical malpractice that occurred in the Bronx Hospital and a multitude of injuries suffered by the infant plaintiff, the infant and mother received a substantial multimillion dollar recovery.
