Medical Malpractice

Negligent Burn Injury Treatment

In 2009, someone suffered a burn-related injury every 31 minutes, according to the Centers for Disease Control and Prevention. Every day, approximately 435 children were treated in the emergency room for burn-related injuries.

Burn injuries can be both physically and emotionally scarring. Even after recovery, a burn can cause irreparable damage to an individual’s self-esteem.

Types of Burns

There are several types of burns ranging from fairly minor that heal quickly to severe trauma.

  • First degree burns involve the surface of the skin and cause pain, redness, swelling, as well as being sensitive to the touch. Sunburns are considered first degree burns.
  • Second degree burns are a more severe and affect the outer layer of skin plus the underlying layer of skin. In addition to redness, pain, swelling and blisters, these burns also can affect the hair follicles and sweat glands. If a second degree burn is deep and not treated properly, it can become a third degree burn. Coming in contact with flames, hot liquids or chemicals can lead to this type of burn, as well as severe sunburns.
  • Third degree burns are the most severe and affect the outer layer and deep underlying layers of skin. There is pain associated even if the area is numb. Third degree burns can result from contact with corrosive chemicals, electricity, extremely hot objects or when your clothing catches fire and burns the skin.

No matter what type of burn you receive, if it is not treated properly and in a timely manner by your health care provider, you may have a medical malpractice claim.

Burn Injury Medical Malpractice

Negligent burn injury treatment can be a form of medical malpractice if a health care provider’s inadequate care causes you further injury and pain. Medical malpractice can also happen when a health care provider causes a burn during a medical procedure.

Depending on the type of burn injury or the procedure that caused the burn, you could have a legally valid medical malpractice claim. You may be eligible for compensation related to medical bills, lost wages and pain and suffering.

In order to prove medical malpractice related to your burn injury, several issues need to be considered:

  • Was the treatment administered by the health care provider below the standard of care that any other reasonable medical professional would have used in the same situation?
  • Was your burn injury worsened as a direct result of the health care providers’ actions?
  • Have you incurred damages that are recoverable such as additional medical bills, lost wages or pain and suffering?

If your loved one suffered from negligent burn injury treatment and died, additional damages may be considered in the medical malpractice claim.
