Surgical Errors

As horrifying as it is to consider, surgical errors are more common than we think. There are many ways a surgical error can occur.

In some instances, an error occurred in the lab and the wrong person ends up having a perfectly healthy piece of them removed that they were told was cancerous. In other cases, a surgeon may not cut with enough precision. For example, when a surgeon nicks a ureter during a routine hysterectomy it is an instance of surgical error.

However, in order for surgical error to be considered medical malpractice, the medical provider must have failed to offer the standard of care, committed an act of negligence or failed to obtain informed consent.

Surgical errors can cause extreme suffering to those involved. If you or a loved one was the victim of a surgical error, you may have a valid medical malpractice claim and could recover losses.

Statistics

In an recent study on surgical errors by the University of Colorado School of Medicine in Denver, a group of 6,000 doctors in Colorado reported 27,370 adverse events occurred during surgeries between 2002 and 2008. Twenty-five of these were wrong-patient errors and 107 were wrong-site errors.

If you are one of the thousands of people who are victims of surgical errors, it is important to learn your rights. If the error was the result of below standard of care and negligence by the health care provider, then you are entitled to compensation for your trauma.
