What to Do If You Suspect Hospital Negligence
The law firm of Silberstein, Awad and Miklos has been serving the people of New York for over 30 years. As medical malpractice attorneys, we have decades of combined experience representing those who have been injured by hospital negligence.
If you suspect you or a loved one has been the victim of medical or hospital negligence, there are many important steps you should take to protect your rights. These steps include:
- Make note of all people involved in the care. This includes the names of all the doctors, nurses and technicians who participated in the care and treatment of the patient.
- If any type of surgically implanted device was removed as a result of treatment, you should request that the item be retained and turned over to you. You should make the request in writing to the surgeon involved and to the hospital or surgical center. If they refuse your request, ask to have their refusal put in writing.
- If you are suspicious of hospital negligence, you should obtain a second opinion regarding the care and treatment you or your loved one received from a physician unaffiliated with the hospital or doctors whom you suspect were negligent.
- Get copies of all the relevant medical records for your files. Request these records as soon as possible to avoid the chance that the documents will wind up "lost," "misplaced," "updated" or "amended."
- File any lawsuit early so that hospital staff can remember the details of your treatment.
Finally, if you suspect you are the victim of hospital negligence, you should consult with an experienced, qualified medical malpractice attorney as soon as possible. Speed is important because some conditions can be treatable if caught early enough. Also, the treatments to correct the negligence can be expensive. One of the jobs of hospital negligence attorneys is to make sure you do not have to pay for the treatment if the injury was the result of someone else's negligence. Legal representation and advice can help make sure you are compensated as much as possible for your injuries. Also, many states put time limits on the amount of time you have to bring a lawsuit based on hospital negligence.
Other reasons to seek legal advice for injury caused by suspected hospital negligence:
- Financial concerns, both for now and in the future.
- Feeling as if the hospital was dishonest about the cause of the injury.
- Wanting to prevent the doctor from injuring others.
- Learning that the injury could have been prevented.
- To hold the hospital and staff accountable for their actions.
The financial and emotional burden of injuries sustained as a result of hospital negligence can be life-altering. If you or a loved one was a victim of hospital negligence, please contact our medical malpractice attorneys today to discuss your case in New York and NYC including Manhattan, Bronx, Brooklyn, Long Island, and Queens for free!
