Traumatic Brain Injury (TBI) and Children

Long Island, New York

Thousands of people every year suffer traumatic brain injuries (TBI) from falls and accidents. It is especially sad when TBI affect children, retarding their development in often-unforeseen ways. In some cases, the effects of a TBI suffered as a child do not present themselves until years later when they fail to behave or respond the way their peers do in certain circumstances.

If your child suffered a TBI due to a fall or accident and that injury is now presenting itself, you may be able to collect damages from those responsible for the injury. The law firm of Silberstein, Awad, & Miklos, P.C. would like to visit with you to see if you have a case.

Causes of TBI in Children

While a brain injury may occur for almost any reason, there are several causes of brain injury that are somewhat common, including:

Many times, defective products like cribs, strollers, and toys may lead to injuries that result in brain damage. If the injury occurred because of a defective product, you may be able to collect damages for the injury from the responsible party.

TBI Classifications

Open brain injuries are defined as an open or penetrating wound that breaks through the skull and causes traumatic physical damage to the brain. The effects of an open brain injury are typically apparent.

Closed brain injuries are harder to define, because you cannot see them. Because a child's brain is still developing, it doe not fit snuggly inside the skull. This allows the brain to move and strike the edges of the skull, sometimes twice. This action is known as coup and contracoup. Brain contusion and concussion are common results of this action.

Signs and Symptoms of Brain Injury

If you suspect any type of injury, it is imperative that you seek medical help immediately. All to often, with a traumatic brain injury, the consequences of an injury may not appear right away. Some closed head injuries, if left untreated may lead to permanent brain damage, and even death. Do not take any chances and have your child seen if you notice any of the following:

  • Dizziness
  • Dilated or unequal pupils
  • Nausea
  • Vomiting
  • Unconsciousness
  • Incoherence

After an injury is established, damages can be sought if impairment is proven. In some cases, the loss of ability will be readily apparent. In other cases, an expert neuropsychologist may need to be called to show the jury the loss of cognitive ability associated with the TBI. If your child was injured in an accident and suffered from TBI, please contact the New York TBI attorneys Silberstein, Awad, & Miklos, P.C. to schedule a free initial consultation for your case.
